As it prepares to host Bob Dylan, Lynyrd Skynyrd and Sheryl Crow next month, The Backyard at Bee Cave is facing allegations of breach of contract for construction work at the outdoor amphitheater.

Maldonado Construction & Associates based in Bertram, Texas, filed suit July 13 in Travis County 98th District Court against several entities, including the venue’s owner Direct Events.
Direct Events President Tim O’Connor is listed as the agent who agreed to the contract with the construction firm on behalf of his limited liability companies Planet Earth Music and PEM-JTOC as well as The John Paul DeJoria Family Trust, which co-owns the land, and Doug Moyes, a business partner with O’Connor in Two Lawnmowers, all of which were named as defendants in the lawsuit.
Maldonado claims in its petition that the firm and its subcontractors are owed $344,801 for construction work and labor from January to May on detention ponds and roads and utility work at the site.
After closing its previous venue in Bee Cave in October 2008, The Backyard at Bee Cave re-opened April 25 at its new location near Texas 71 and Ranch Road 620, but parts of the venue remained unfinished as it welcomed ZZ Top.
The Backyard paid some of its invoices dated up through March, but Maldonado stated that several attempts to settle accounts from January to May were unsuccessful.
“Despite repeated demands, defendants have refused to pay the amounts reflected in the invoices owed to [Maldonado Construction] in the total amount of $344,801,” the suit states.
Direct Events Marketing Coordinator Kylee O’Neil did not return calls, but a company representative said officials were not interested in commenting on the lawsuit and would not respond to further attempts to obtain information.
