A car crash on Texas 71 near Spicewood left a father and two of his children dead this weekend, Texas Department of Public Safety officials said.
Russell Kyle Rutland, 37, Madison Rutland, 4, and Hunter Rutland, 9, all of Spicewood, were killed Saturday when their 2005 Nissan sedan collided with a 2007 Dodge pickup truck driven by John Wesley Horn, 29, of Kingsland, officials said.
Horn, along with two other Rutland children; Cole, 5, and Zachary, 10, were taken to area hospitals with unspecified injuries, according to officials.
“Mr. Horn’s vehicle was westbound on Texas 71 in the inside lane and Mr. Rutland’s vehicle was eastbound on Texas 71 in the outside lane,” DPS officials said via e-mail. “Mr. Horn’s vehicle crossed the double yellow lines, striking Mr. Rutland’s vehicle on the left front as Mr. Rutland took evasive action.”
Burnet County Justice of the Peace, Precinct 4, Edward Cutchin, pronounced Rutland and the two children dead at the scene. All three were wearing their seatbelts.
Currently, officials said, Horn has been charged with driving while having an invalid license but DPS officials say they may charge him with three counts of criminally negligent homicide.
Considered a state jail felony, this charge would result in up to two years in prison per offense with fines up to $10,000 per offense, if Horn were to be charged and convicted.
Family members have set up a memorial trust fund for the surviving children at Security State Bank and Trust, 608 U.S. 281, Marble Falls. Checks can be made payable to “The Russell Kyle Rutland Children’s Fund.”
