Police have released a photograph of the man they say attempted to shoot an Iguana Grill employee who attempted to prevent him from driving while he appeared intoxicated earlier this month.

 Authorities said the suspect subsequently shot a man who was driving on Oasis Bluff Drive later on the same day.
“Based on [the] investigation, it is apparent that on May 11, 2009, Robert T. Bence intentionally and knowingly pointed his Sig 9mm pistol at Iguana Grill employee Timothy Huston and pulled the trigger several times without it firing,” Travis County Detective Greg Lawson said in the probable cause affidavit.
“He then left the Iguana Grill and while driving to his residence, he drove past Charles Dillard’s pickup being operated by Dillard on Oasis Bluff, and fired at least two shots that stuck Dillard’s driver’s side door. One bullet entered the interior cab and struck Dillard in the abdomen, causing him serious bodily injury, thus committing Aggravated Assault with a Deadly Weapon.”
Robert T. Bence Jr., 50, of Leander, has been charged two counts of aggravated assault with a deadly weapon. The second-degree felony charge is punishable by up to 20 years in prison and fines up to $10,000.
Bond was set at $200,000 for one charge and $300,000 for the other.
“At this point, the case is progressing and getting handed over to the D.A.’s office,” Travis County Sheriff’s Office Spokesperson Roger Wade said. “He’s been magistrated. The next step is indictment.”
Bence allegedly shot Dillard as they were both traveling north near the 6700 Block of Oasis Bluff Drive May 11. Dillard immediately transported to Brackenridge Hospital. As of last week, he was listed in good condition.
According to the report, the ordeal began when Bence ordered two drinks at the Iguana Grill but was unable to finish the second before getting up to go to the bathroom. The affidavit says that Huston observed Bence stumbling and said he appeared intoxicated. When he followed him out to his car in what the report says was an attempt to call him a cab, “the white male lifted his hand and pointed what appeared to be a small handgun at him.”
Police used Huston’s description of Bence’s car and license plate to find Bence at his Leander home later that day. Police say Bence was wearing the same clothes as the man in the security camera footage from the Iguana Grill restaurant.
They arrested him there and also recovered a Sig Sauer pistol, according to the affidavit. Also according to the affidavit, Police recovered the bullet that hit Dillard and will be running comparative ballistics in an attempt to match it to the recovered gun.

    I knew about the Oasis Bluff shooting but didn’t know about the Iguana Grill situation. This guy needs to be locked up for a long time. Thanks for the info.
